Constitutionality of NY SAFE Act Upheld in Court

This past Thursday, a NY State Supreme Court judge dismissed the case challenging the NY SAFE Act of 2013 that was hastily passed in the middle of the night. 

Judge Thomas McNamara dismissed the case because the governor and legislators did nothing unconstitutional when they passed the bill without a three day waiting period. In addition, the judge said the plaintiffs did not prove the law infringed on their state constitutional rights.

The plaintiff, Robert Schulz of the group “We the People of New York,” plans to appeal.
